1. About these terms
These terms are an agreement between you and Lucero Studio, Morlans, San Sebastián, Spain, who runs Tattoonic ("we", "us"). They apply to the Tattoonic apps for iPhone, iPad and Android, to the web app at https://app.tattoonic.com and to the website at https://tattoonic.com, together "Tattoonic".
By creating an account, buying Pro or using Tattoonic, you accept these terms. If you do not accept them, do not use Tattoonic.
2. What Tattoonic does
Tattoonic makes AI tattoo designs from your words or your photos: designs from an idea or from a photo, lettering, a tattoo on a photo of your skin, a design tried on your skin, cover-ups of old tattoos, previews of a tattoo fading with laser sessions or healing over the years, and stencils. You describe what you want or upload a photo, choose options, and an AI model makes a new image. Each design gets a short note written by AI. The Ideas section shows example designs made by us. With Pro, you can also talk to an AI assistant that makes and refines designs from your messages and photos and answers questions about tattoos.
The designs, notes and replies are made by AI models that other companies run for us. We cannot promise that a result will look the way you expect or meet your needs.
3. Privacy
Our privacy policy explains what we collect, why, and who helps us run Tattoonic. It is part of these terms.
4. Age and your account
- You must be at least 17 years old to use Tattoonic or buy Pro.
- Give a real email address and keep your sign-in details safe. You are responsible for what happens in your account.
- An account can be signed in on one device at a time. Signing in on a new device signs out the others. Do not share an account with other people.
5. Free and Pro
- Free: a number of designs each day. Images you save, share or print, stencils included, carry a Tattoonic watermark.
- Pro: more designs each day, no watermark on designs and stencils, and the assistant.
Each plan has daily limits, and the app tells you when you reach one. Daily limits start over each day in your time zone. A design that fails does not count toward your limit.
6. Buying Pro
Plans and prices
- Pro is sold as a weekly or a yearly subscription, or as a lifetime purchase. Not every plan is offered on every platform or in every country.
- The price, the billing period, any free trial and any tax are shown before you confirm a purchase. Prices can differ between the App Store, Google Play and the web, and between countries.
- A lifetime purchase is paid once. It keeps Pro on the account that bought it for as long as we offer Tattoonic.
In the iPhone, iPad and Android apps
Apple (App Store) or Google (Google Play) sells and bills Pro in the apps, under their own terms. For these purchases:
- Payment is charged to your Apple ID or Google account when you confirm the purchase.
- A subscription renews automatically for the same period and price unless you turn off auto-renewal at least 24 hours before the current period ends.
- The renewal is charged within the 24 hours before the current period ends.
- You manage and cancel subscriptions in your App Store or Google Play account settings after purchase. In Tattoonic, open Profile, then Plan, and choose Manage subscription to go there.
- If a free trial is offered, any unused part of it ends when you buy a subscription.
- When you cancel, Pro stays on until the end of the period you paid for. You are not charged again.
- Refunds for these purchases follow Apple's and Google's rules: ask them.
On the web
On the web, we sell Pro. Our payments provider, RevenueCat, runs the checkout and Stripe processes the payment. For these purchases:
- You pay when you confirm the purchase.
- A subscription renews automatically for the same period and price until you cancel it. Cancel before the end of a period to avoid the next charge. Open Profile, then Plan, and choose Manage subscription, or write to us.
- When you cancel, Pro stays on until the end of the period you paid for.
- For refunds, write to support@tattoonic.com.
Right of withdrawal (EU and UK, web purchases)
If you live in the European Union or the United Kingdom and buy Pro on the web, you can withdraw from the purchase within 14 days, without giving a reason. The 14 days start on the day of the purchase.
To withdraw, tell us before the 14 days end with a clear statement: an email to support@tattoonic.com is enough, or you can use the model form below. We refund you within 14 days of hearing from you, with the same means of payment, at no cost to you.
Pro is a service that runs for as long as your plan lasts. If you asked us at checkout to start Pro straight away, within the 14 days, and you then withdraw, you pay for the Pro you had until you told us: we refund the price less an amount in proportion to that time. If you did not ask for Pro to start straight away, we refund the full price.
The lifetime plan is the same Pro service, with no end date, so the same right of withdrawal applies to it. For the time you had it, we charge the yearly plan's daily rate: the price of the yearly Pro plan on the web when you bought, divided by 365, for each day until you told us. We refund the rest of the price.
If you live in the United Kingdom, you also have the rights that UK law on subscription contracts gives you, including any notices and cancellation periods it requires.
For App Store and Google Play purchases, refunds and withdrawals go through Apple's and Google's own processes: ask them.
Model withdrawal form (fill it in and send it only if you want to withdraw):
- To: Lucero Studio, Morlans, San Sebastián, Spain, support@tattoonic.com
- I hereby give notice that I withdraw from my contract for the following service: Tattoonic Pro, plan: ___
- Ordered on: ___
- Name: ___
- Address: ___
- Email address of the Tattoonic account: ___
- Signature (only if you send it on paper): ___
- Date: ___
Changes and cancellation
- If a price changes, we or the store tell you before the new price applies, and you can cancel before it does.
- Deleting the app or your account does not cancel a subscription. Cancel it in the store or account where you bought it.
7. Using Tattoonic fairly
In general
You agree not to:
- Use Tattoonic for anything illegal, or in a way that infringes other people's rights.
- Try to get around the daily limits, the watermark, the one-device rule or our security.
- Copy, decompile or reverse engineer Tattoonic, except where the law allows it.
- Resell, rent or redistribute Tattoonic, scrape it, or use it to build a competing service.
- Overload Tattoonic, or use bots or scripts to make designs.
With the AI tools
You agree not to use Tattoonic to:
- Harm, exploit or sexualise children in any way.
- Deceive people, for example by passing a design off as a photo of a real tattoo, or as another artist's work, or by spreading false information.
- Harass, bully, threaten or humiliate anyone, or show real people in a false, hurtful or sexual way.
- Discriminate against people or groups.
- Make things that infringe copyrights, trademarks or other rights.
What you may not upload or create
- Illegal content.
- Sexual or nude content, or photos showing intimate parts of the body. Tattoos on the chest, back, ribs or thighs are fine.
- Hateful, violent or gory content.
- Photos of a child, or of a child's body.
- Photos of another person's face or body without their consent.
- Malware, or anything meant to harm Tattoonic or its users.
We may remove content or suspend an account that breaks these rules. We may report illegal content to the authorities.
8. Your content
"Your content" means the photos you upload, the words you type, your messages to the assistant, and the designs and notes made for you.
When you upload a photo, you promise that:
- You took it, or you have permission to use it.
- Every person who can be recognised in it, or whose body it shows, is an adult and has agreed.
- It shows no work you may not copy, such as another artist's design you have no permission to use.
Your content stays yours. You give us a licence to store, process and show it, and to send it to the providers named in our privacy policy, only to provide Tattoonic to you. This licence ends when you delete the content or your account.
9. AI results are references, not tattoos or medical advice
Designs, notes and assistant replies are made by AI. They can be inaccurate, change things you did not ask for, or show details that would not hold up as a real tattoo. They are visual references for inspiration and for talking with a tattoo artist.
- A design is a reference for a licensed tattoo artist, who should redraw it for your skin, its size and its place on your body. Fine details may not hold at tattoo size, and a tattoo on a photo shows an idea, not how it will heal on you.
- Lettering: Tattoonic copies the letters you type, but check the spelling, the grammar and the meaning yourself before you get it tattooed, above all in a language or script you do not read.
- Fade, removal and healing previews are simulations, not predictions for your skin. How a tattoo heals, ages or fades with laser sessions depends on your skin, the ink, the artist and the treatment.
- Stencils: the size of a printed stencil depends on your printer and its settings. Measure the print before you use it.
- Health: what the assistant or a note says about pain, aftercare, allergies, scars, skin conditions or removal is general information, not medical advice. Ask a doctor, a dermatologist or a licensed artist before you get a tattoo or have one removed.
The decision to get a tattoo, where and by whom, is yours. We are not responsible for a tattoo you get, its removal or how it turns out.
10. Intellectual property
Ours
Tattoonic, its name and logo, its design, pictures, texts and software belong to us or our licensors. We give you a personal, limited, non-exclusive, non-transferable right to use Tattoonic under these terms. We can take this right back if you break them.
Yours
As between you and us, you own the designs made for you, as far as the law allows rights in them. You may use them as you like, including commercially, within the law and these terms. Designs from the free plan carry a watermark; do not remove it.
AI models can make similar designs for other people from similar words, photos and choices, and a design may look like an existing tattoo or artwork. You do not get exclusive rights to a style or a look, and other people's similar designs are not yours. Before you get a design tattooed, make sure it does not copy someone else's work, logo or character.
The example designs in the Ideas section are ours. You may use them as references for your own tattoo, including having them tattooed, but not resell or redistribute them.
Copyright complaints
If you believe something in Tattoonic infringes your copyright, write to support@tattoonic.com or to Morlans, San Sebastián, Spain. Include: your contact details; the work you believe is infringed; where the content is in Tattoonic; a statement that you believe in good faith that the use is not authorised; a statement, under penalty of perjury, that your notice is accurate and that you own the right or may act for its owner; and your physical or electronic signature. We may remove the content and tell the person who uploaded it, who can send a counter-notice to the same address.
11. Other services and links
Tattoonic links to services we do not run, such as the App Store, Google Play and the sign-in pages of Apple and Google. Their own terms and privacy policies apply to them, and we are not responsible for them.
12. Availability, changes and ending the agreement
- We may change, add or remove features, or limit or stop Tattoonic. If we remove something you pay for, we tell you first.
- Tattoonic needs an internet connection. Your mobile operator's data charges are yours.
- You can stop using Tattoonic and delete your account at any time. See the account deletion page.
- We may suspend or close your account if you break these terms, if the law requires it, or if we stop offering Tattoonic. If we close your account without a breach on your part, we tell you first when we can, and refund any prepaid period we billed directly.
- The parts of these terms that by their nature should last, such as those on intellectual property, liability and governing law, stay in force after the agreement ends.
13. No warranties
We provide Tattoonic "as is" and "as available". We work to keep it running, safe and correct, but we do not promise that it will always be available, free of errors or secure, or that designs will meet your expectations. As far as the law allows, we give no other warranties, express or implied.
14. Limits of our liability
To the extent the law allows:
- We are not liable for indirect or consequential losses, lost profits or data, or losses caused by relying on AI results, including the cost of a tattoo, its removal or cover-up, or any purchase based on a design.
- Our total liability to you is limited to the amount you paid us for Tattoonic in the 12 months before the claim.
- You will compensate us for claims by others caused by content you uploaded or by your breach of these terms.
Nothing in these terms limits liability that the law does not allow us to limit, such as for death or personal injury caused by negligence, or for fraud. Nothing in these terms takes away rights you have as a consumer under the law where you live.
15. Following the law
You may not use Tattoonic if you are in a country under a comprehensive embargo, or on a government list of people who may not receive services. You are responsible for following the laws that apply where you use Tattoonic.
16. Governing law and disputes
These terms are governed by the laws of Spain. Disputes go to the courts of Spain.
If you are a consumer, you keep the protection of the mandatory laws of the country where you live, and you can also bring a claim in its courts. We would like to hear from you first: most problems are solved with an email.
17. Changes to these terms
We may update these terms. The date at the top shows the latest version. If a change matters to you, we tell you in the app or by email before it applies. If you keep using Tattoonic after that, the new terms apply. If you do not accept them, stop using Tattoonic and cancel any subscription.
18. General
- If a court finds part of these terms invalid, the rest stays in force.
- You may not transfer your rights under these terms to anyone else. We may transfer ours to a company that takes over Tattoonic, without reducing your rights.
- If we do not enforce a right at once, we do not give it up.
- These terms and the privacy policy are the whole agreement between you and us about Tattoonic. If you got Tattoonic from the App Store or Google Play, section 19 and that store's own terms also apply, and section 19 wins where it differs from the rest.
19. If you got Tattoonic from the App Store or Google Play
App Store
If you downloaded Tattoonic from Apple's App Store, these terms also include the following, which win over anything else in them:
- These terms are between you and us, not Apple. We, not Apple, are responsible for Tattoonic and its content.
- Your right to use Tattoonic is limited to Apple-branded devices that you own or control, as the Usage Rules in Apple's Media Services Terms and Conditions allow, including use by other accounts through Family Sharing where those rules allow it.
- We alone provide maintenance and support for Tattoonic. Apple has no obligation to provide any maintenance or support for it.
- If Tattoonic fails to meet a warranty that applies to it, you may tell Apple, and Apple will refund the price you paid for Tattoonic, if any. To the extent the law allows, Apple has no other warranty obligation for Tattoonic. Any other claims, losses, liabilities, damages, costs or expenses caused by a failure to meet a warranty are our responsibility, as far as these terms and the law make them so.
- We, not Apple, are responsible for handling any claims by you or anyone else about Tattoonic or your use of it, including product liability claims, claims that Tattoonic fails to meet a legal or regulatory requirement, and claims under consumer protection, privacy or similar laws.
- If anyone claims that Tattoonic or your use of it infringes their intellectual property rights, we, not Apple, are responsible for the investigation, defence, settlement and discharge of that claim.
- You confirm that you are not in a country that is subject to a United States Government embargo or that the United States Government has designated as a "terrorist supporting" country, and that you are not on any United States Government list of prohibited or restricted parties.
- When you use Tattoonic, you must also follow the terms of third parties that apply to you, such as your mobile data provider's.
- Questions, complaints and claims about Tattoonic go to us, not Apple: Lucero Studio, Morlans, San Sebastián, Spain, support@tattoonic.com.
- Apple and its subsidiaries are third-party beneficiaries of these terms. Once you accept them, Apple has the right, and is deemed to have accepted it, to enforce these terms against you as a third-party beneficiary.
Google Play
If you downloaded Tattoonic or bought Pro on Google Play, Google Play's Terms of Service also apply to the download and the purchase. Google is not a party to these terms and is not responsible for Tattoonic.
